How To Register a Trademark in Rwanda

How to Register a Trademark in Rwanda: did you know that the registration of trademarks is handled by the office of the Registrar General? Registering your business’s trademark, logo, and business name is crucial for safeguarding your brand. It guarantees exclusive rights to operate and market under the registered trademark, logo, or trade name, preventing other businesses from using or infringing upon your intellectual property rights.

At Stabit Advocates, we have witnessed numerous instances where consumers are attracted to products based on their branding, name, or logo. This highlights the importance of registering your trademark to protect your brand from unauthorized use. A prominent example is the renowned brand “Apple.” Despite the presence of alternative products serving similar purposes, Apple products maintain a loyal customer base due to their established reputation for quality and reliability. The protection of Apple’s brand through intellectual property rights has been instrumental in preventing counterfeit products from flooding the market.

Trademark Registration Procedure

It is advisable to conduct a trademark search before proceeding with registration. This ensures that the trademark you intend to register is not already in use and that it complies with the elements outlined by intellectual property law.

Elements of a Registerable Mark

A mark can only be registered if it possesses the following elements:

  • Distinctiveness: The mark should allow the products or services of one company to be distinguished from those of other companies.
  • Non-Imitative: The mark should not be identical to or confusingly similar to a well-known trademark or trade name in Rwanda for identical or similar products. It should not cause confusion with pre-existing marks.
  • Non-Confusing: The mark should not mislead the public or traders, particularly regarding the geographical origin, quality, nature, or characteristics of the products or services.
  • Non-Descriptive: The mark should not merely describe the essential characteristics of the products or services.

Requirements for Trademark Registration

An application for trademark registration should include the following:

  • An application letter addressed to the Registrar General
  • Completed application form
  • Meaning or translation of the mark, if applicable
  • Trademark search results, if available
  • Reproduction of the mark
  • List of products or services for which registration is requested, listed in the order of the relevant classes of the international classification
  • Proof of payment of registration fees
  • Copy of Company Certificate
  • Copy of ID or Passport of the applicant’s representative

The duration of trademark validity is ten (10) years from the filing date of the application. It can be renewed upon application and payment of renewal fees for another ten years each time it is renewed.

Conclusion

In summary, registering your trademark ensures that your business can trade exclusively under its brand. If your business provides high-quality services and expands its market, trademark registration will be advantageous by preventing other companies from using your brand. The application process for trademark registration in Rwanda is straightforward, provided the trademark complies with Rwandan intellectual property laws.
