This acceleration reflects a profession increasingly willing to embrace AI-driven efficiency. Yet the speed of this transformation raises a question that Katherine Hughes, Clinical Professor at Fordham University School of Law, former Cleary Gottlieb pro bono counsel, and member of the NYC Bar Presidential Task Force on Artificial Intelligence, has posed with particular urgency: “Where is the ethical pause?” Hughes, who encourages students and practitioners to approach technology with a “balance of curiosity and caution,” reminds us that AI tools cannot replace the “diligence, curiosity, and judgment of a good lawyer” and of course, this caution is not a rejection of technology, but rather a call for active deliberation before uploading client data into multilayered systems where confidentiality obligations may be compromised at any integration point.

The promise of these ecosystems is real – but so are the dangers they pose to the foundational duties that define the legal profession.

The company launched more than 20 MCP connectors linking Claude to platforms spanning document management (iManage, NetDocuments), e-discovery and litigation (Relativity, Everlaw, Consilio), contract lifecycle management (Ironclad, DocuSign), legal research (Thomson Reuters, Trellis, Midpage), and patent work (Solve Intelligence). The 12 practice-area plugins cover Commercial, Corporate (including M&A diligence), Employment, IP, and Litigation, among others.
A notable feature of Anthropic’s approach is the “setup interview” each plugin begins with, allowing the AI to learn a team’s specific playbooks, risk calibration, and house style. The bidirectional integration with Thomson Reuters is particularly significant as Anthropic also introduced access-to-justice partnerships with the Free Law Project and the Justice Technology Association, along with a Claude for Nonprofits discount program.
Microsoft’s Enterprise-Native Approach
On the Microsoft side, their strategy builds on their existing dominance in law firm infrastructure. The Copilot integration with Litera aims to “streamline workflows, improve document drafting and amplify” legal professional capabilities. NetDocuments also expanded its Microsoft integrations in May 2024, connecting Copilot to its document management system through the ndMAX AI engine for “advanced, legal-specific automation capabilities.” At Microsoft Build 2024, even Evisort was featured as one of just 30 strategic partners chosen to demonstrate an advanced integration with Copilot and Teams, showcasing how its proprietary contract-specific LLM could surface deep contract insights within the Microsoft ecosystem.
One would argue that even the broader market is also consolidating rapidly if we are to look at LexisNexis which has set a goal for its Protege platform to automate 15-20% of lawyer tasks by 2028, in the same market where Litera introduced its own agentic assistant, Lito.2
Comparative Overview
Both platforms promise to reduce friction and consolidate fragmented workflows. However, each integration point introduces new data-handling entities, new terms of service, and new potential failure modes. The very complexity these ecosystems aim to eliminate may be reintroduced at a deeper, less visible layer.
Confidentiality Under Siege: ABA Model Rule 1.6 and the Data Governance Imperative
The foundational obligation of every attorney is the duty of confidentiality. Just like any other bar association across the globe, the ABA Model Rule 1.6 states plainly: “A lawyer shall not reveal information relating to the representation of a client unless the client gives informed consent.” In the context of unified legal-tech ecosystems, this rule acquires new and urgent dimensions.
The Multilayered Data Risk
When a lawyer uploads a contract to Claude for review, that document may traverse multiple integration layers – from the Claude interface to a Thomson Reuters CoCounsel connector, then potentially to an iManage document management system. Each layer represents a separate data-processing entity with its own privacy policies, security posture, and retention practices. Hughes’ question of “Where is the ethical pause?” – is particularly apt here and it is imperative to have this ethical pause occur before a single keystroke of client data enters a system whose full data flow the lawyer has not mapped out and or understood.
The consequences of failing to pause are not hypothetical. As one industry report documented, a mid-sized law firm adopted an AI tool to speed up contract review, only to discover six months later that “confidential client data had been uploaded to an unsecured platform and used to train a third-party AI model.” This breach “exposed privileged communications, triggered bar complaints and malpractice claims, and caused irreparable damage to client trust.” This scenario illustrates precisely the risk that Rule 1.6 and other rules alike the world over were designed to prevent.
Formal Ethics Guidance
The ABA responded to these challenges in July 2024 with Formal Opinion 512, its first comprehensive ethics guidance on a lawyer’s use of AI tools. The opinion identifies ethical issues involving generative AI and “offers general guidance for lawyers attempting to navigate this emerging” technology, as did the NYC Bar Association follow with its own Formal Opinion 2024-5, which explicitly states that “a lawyer should obtain client consent for Generative AI use if client confidences will be disclosed in connection with the use of Generative AI.”
ABA Model Rule 5.3 compounds this obligation. A lawyer “shall be responsible for conduct of such a person that would be a violation of the Rules of Professional Conduct if engaged in by a lawyer” and this is precisely applicable when the AI serves as a nonlawyer assistant – drafting memos, analyzing contracts, conducting research, a scenario in which the supervising lawyer bears the same ethical accountability as if a junior associate or paralegal had performed the work meaning, with 20+ connectors, the supervision obligation multiplies.
Global Equivalents
These obligations are not confined to the American legal system. GDPR Article 5 establishes principles of data minimization, purpose limitation, accuracy, storage limitation, and accountability, requiring that “the controller shall be responsible for, and be able to demonstrate compliance with” these principles. The transparency challenge is particularly acute when data crosses borders. Firms handling matters in Hong Kong, for instance, face complex intersections of AI use, legal privilege, and cross-border risk that have no simple resolution. The fundamental question still remains: when client data enters an AI ecosystem, can the firm trace precisely where it goes, who processes it, and how long it persists?
Ethical Layering of Integrations
When Claude connects to Thomson Reuters CoCounsel through a bidirectional MCP integration, which in turn may access documents stored in iManage, each layer introduces a new data-processing entity with its own terms of service and privacy policies. ABA Model Rule 5.3 requires lawyers to supervise each of these layers as they would a nonlawyer assistant and the NYC Bar Opinion 2024-5 also addresses these layered ethical obligations, emphasizing that firms must proactively manage the risks of unauthorized data exposure at each integration point.
The practical challenge is daunting. A single document review workflow in Anthropic’s ecosystem might involve Claude as the AI engine, Relativity for e-discovery processing, iManage for document storage, and Thomson Reuters for legal research validation. Each connector represents a contractual relationship, a data-processing agreement, and a potential breach surface. The lawyer’s supervisory obligation under Rule 5.3 and other rules like it does not diminish with each additional layer – it only compounds.
Tech Stack Fatigue and the Paradox of Simplification
The legal industry has reached what practitioners themselves describe as “peak LegalTech fatigue,” where “every new tool claims it will ‘redefine the practice of law.'” IT friction is costing law firms time and talent, with attorneys increasingly burdened by the cognitive overhead of managing fragmented tools as one commentator observed that, “For an industry that thrives on solving complex problems, law firms have a curious habit of clinging to inefficiency” Tobias Warken.
The paradox is that unified ecosystems promise to solve tech stack fatigue while potentially recreating it at a deeper level. A firm that adopts Claude’s full suite of 20+ connectors now has 20+ vendor relationships to manage, 20+ security postures to audit, and 20+ sets of terms to review. Therefore, the tool meant to simplify has introduced a new category of complexity.
Emerging Risks the Legal Community Has Not Yet Fully Comprehended
Beyond the recognized concerns, five categories of risk are emerging that the legal profession has not yet fully grappled with. Each is grounded in existing legal frameworks but represents a novel application triggered by the rise of unified AI ecosystems.
1. Jurisdictional Conflicts in Data Protection
A single client matter handled through a unified legal-tech ecosystem can trigger multiple, potentially conflicting regulatory frameworks simultaneously. GDPR mandates data minimization under Article 5 and requires a lawful basis and specific consent under Article 7. HIPAA also imposes separate requirements for health-related legal data. On the other hand, the EU AI Act, meanwhile, classifies AI systems used in the “administration of justice and democratic processes” as “high-risk” under Annex III, subjecting them to additional obligations including risk management systems, data governance, and human oversight.
Cross-border data transfer challenges under GDPR Chapter 5 further complicate the picture. When Claude processes a European client’s medical records as part of a US litigation matter, which framework governs? I think the legal community can agree that these intersections remain unresolved.
2. Algorithmic Accountability and Product Liability
The NTIA has stated that “a great deal of work is being done to understand how existing laws and legal standards apply to the development, offering for sale, and/or deployment of AI technologies.” The FTC has already taken action against companies engaged in allegedly deceptive advertising about AI capabilities and has obtained relief “including the destruction of algorithms developed using unlawfully obtained data.”
University of Virginia professor David Danks warns that current accountability models often force humans to act as “perpetual scapegoats” for AI errors, pointing to scenarios where professionals must sign off on AI output without sufficient time or ability to review them. Drawing a parallel to the product liability framework established in Greenman v. Yuba Power Products, one can ask: if an AI legal tool generates defective analysis that causes client harm, should the developer bear strict liability, or does the supervising attorney absorb all risk? 3. Client Consent Obligations Under Model Rule 1.4
ABA Model Rule 1.4 requires lawyers to keep clients “reasonably informed about the status of the matter” and to “explain a matter to the extent reasonably necessary to permit the client to make informed decisions.” And because, the NYC Bar Formal Opinion 2024-5 specifies that lawyers “should obtain client consent for Generative AI use if client confidences will be disclosed,” with 20+ connectors in Anthropic’s ecosystem, the challenge of obtaining truly informed consent becomes exponentially complex. Clients would need to understand not just that their data is being processed by “AI,” but which specific models, sub-processors, and third-party platforms handle their information. The consent complexity spiral – where each additional integration makes meaningful informed consent harder to achieve – represents a structural challenge that no current ethics opinion has fully addressed.
4. Monopoly and Antitrust Risks
In United States v. Microsoft Corp. (1998), the government accused Microsoft of “illegally monopolizing the web browser market for Windows, primarily through the legal and technical restrictions” it imposed. Charges were brought to determine “whether its bundling of additional programs into its operating system constituted monopolistic actions” and the court found that “three main facts indicate that Microsoft enjoys monopoly power,” including its overwhelming market share in Intel-compatible PC operating systems.
The parallels to today’s legal-tech consolidation are striking. When Microsoft bundles Copilot AI capabilities into Microsoft 365 – the suite that most law firms already use for Word, Outlook, and Teams – the structural dynamics mirror the browser-bundling strategy of the 1990s. If legal workflows become dependent on a single ecosystem, switching costs create precisely the kind of lock-in that antitrust law is designed to prevent.
5. Auditability and Evidentiary Standards
The Advisory Committee on Evidence Rules is actively considering how courts should evaluate AI-generated evidence. Proposed Rule 707, advanced in May 2026, would govern AI and machine-generated evidence, while proposed Rule 901(c) addresses deepfakes and fabricated digital content. These proposals signal that courts “no longer view AI evidence as ‘business as usual.'” AI outputs may increasingly be evaluated for “explainability, error rates, validation, and potential bias” – criteria that echo the reliability testing framework established in Daubert v. Merrell Dow Pharmaceuticals (1993).
For lawyers using Claude or Copilot, the evidentiary risk is immediate: if AI-assisted work product is challenged and the lawyer cannot produce audit trails showing which model version processed the data, what prompts were used, and what sources informed the output, that work product could face exclusion.
The Courtroom Reckoning: Evidentiary Standards and the Auditability Gap

The challenges identified in this article are not inevitable consequences of technological progress. They are design choices. Legal-tech companies building unified ecosystems bear a responsibility to architect their platforms in ways that respect the profession’s ethical foundations. 1. Publish Transparent Governance Frameworks
Legal-tech companies must disclose, in plain and specific terms, how data flows through their ecosystems. This means identifying which sub-processors handle client data, how long data is retained at each integration point, and whether any data is used to train or fine-tune models. The current state of affairs – where firms must parse dozens of separate privacy policies across connector partners – is incompatible with the duty of competent supervision and governance frameworks should be published, not buried in terms of service.
2. Build Ethical-by-Design Architectures with Audit Trails
Every AI interaction should be logged with the model version, prompt, timestamp, data sources accessed, and output generated. This directly addresses the auditability gap that proposed Rule 707 is designed to close. These audit trails also enable meaningful compliance with ABA Rule 5.3’s supervision requirement, allowing lawyers to review and verify AI output after the fact. The “setup interview” approach that Anthropic uses for its practice-area plugins is a promising step, but it must be accompanied by comprehensive logging of every downstream action the AI takes.
3. Offer Jurisdiction-Specific Compliance Modules
A firm handling matters across the United States, European Union, and Asia needs tools that automatically adapt to the applicable regulatory framework. The EU AI Act classifies legal AI as “high-risk” under Annex III, imposing obligations for risk management, data governance, transparency, and human oversight under Annex III, GDPR Chapter 5 governs cross-border data transfers with specific adequacy requirements and HIPAA adds a separate layer for health-related data. This is why legal-tech platforms should offer jurisdiction-specific compliance modules that automatically apply the correct data-handling rules based on the matter’s geographic scope, rather than leaving each firm to build its own compliance infrastructure.
4. Collaborate with Regulators and Bar Associations
The RBA, ABA, state bars, the NYC Bar, and their international equivalents are actively developing ethical guidance for AI in legal practice. Professor Hughes’ participation in the NYC Bar Presidential Task Force on Artificial Intelligence exemplifies the kind of practitioner-regulator collaboration that should inform platform design and legal-tech companies should actively participate in these processes, submit to regulatory review, and incorporate feedback into their product development cycles rather than treating compliance as a post-launch afterthought.
5. Ensure Interoperability to Avoid Monopolistic Lock-In
The lesson of United States v. Microsoft Corp. is that bundling can become anticompetitive when it creates dependencies that foreclose meaningful choice. Open standards like the Model Context Protocol (MCP) are promising because they theoretically allow firms to connect AI tools across ecosystems. But openness must be genuine, and not performative. Clients and firms must be able to export their data, switch between ecosystems without losing work product, and avoid proprietary formats that create de facto lock-in. Interoperability is not just a technical design principle – it is an ethical obligation in a market where professional duties are at stake.
Legal-tech can indeed transform the practice of law. But that transformation will be meaningful only if it is built on a foundation that respects the profession’s core duties – confidentiality, competence, diligence, and loyalty – and protects the clients whose interests those duties serve.
Synthesis: Balancing Innovation Against Professional Obligation
The legal-tech landscape is currently defined by a divergence between Anthropic’s modular ecosystem and Microsoft’s integrated enterprise stack.
